04.11 THE QUESTION OF OWNERSHIP

As the various phases of the project are executed, ownership in the various structures formally passes to the people of the project area. Until all debts have been repaid, the project coordinator will retain the right to recover any installation supplied under the project should the people not meet their financial obligations for them. Where formal money seed funds are obtained by way of interest-free seed loan, the interest free loans will be repaid over a period of 10 years. Until repayment has been completed, the project coordinator will retain responsibility for maintenance and administration.

Before the project starts, the project coordinator will offer to provide on-going maintenance, training of maintenance operators, and administration for an agreed fee for at least ten years. Pumps and structures have a life-span of more than 20 years. Once the seed capital has been fully repaid at the end of ten years, on-going monthly contributions will create a large surplus for future renewals and extensions of the project facilities. Until it is needed, this money can be re-invested interest free in micro-credit loans for local development.

Ownership of drinking water installations, PV lighting and refrigeration and water testing equipment installations in schools and clinics will be vested in the tank commissions where the schools and clinics are located. Ownership of installations at tank commission level is vested in the tank commissions. Ownership of installations at well commission level is vested in the well commissions. Ownership of property and equipment at central project level will be vested in the project management.

(How ownership of structures is formally vested at the various levels will vary from project to project.) For this project the creation of several hundred separate trusts and legal entities for the project would be complicated and expensive. Formal ownership will be vested in the project through its chosen Central Management and held by Central Management on trust for the various tank- and well-commissions, the Cooperative Local Development Fund, and the micro-credit and the local money system structures. 

(Ownership of PV lighting sanitation services and refrigeration installations in clinics outside the project area serving users inside the project area needs to be separately discussed. ) (Not applicable for this project).
